Get Ready to Market with SinseFresh

Effective Date: January 1, 2026

By submitting an application to, or participating in, the SinseFresh Affiliate Program (“Program”), you (“Affiliate,” “you,” or “your”) agree to comply with and be bound by the following Terms & Conditions. These terms form a legally binding agreement between you and SinseFresh (“SinseFresh,” “we,” “us,” or “our”).

Participation in the Program is subject to approval at the sole discretion of SinseFresh. We reserve the right to accept or reject any application for any reason, including but not limited to brand misalignment, content quality, or audience relevance. Acceptance into the Program is not guaranteed.

Affiliates participate as independent contractors. Nothing in this Agreement shall be deemed to create any partnership, joint venture, employment, or agency relationship between you and SinseFresh. Affiliates have no authority to bind SinseFresh in any manner.

Affiliates agree to:

• Promote SinseFresh products in a truthful, professional, and ethical manner
• Accurately represent product features without making false, misleading, or unsubstantiated claims
• Avoid any medical, health, or legal claims unless expressly authorized in writing by SinseFresh
• Use only approved marketing materials, logos, and messaging provided or authorized by SinseFresh
   

SinseFresh reserves the right to request modification or removal of any content that violates these standards.

Affiliates must comply with all applicable local, state, federal, and international laws, regulations, and platform policies, including but not limited to:

• FTC affiliate disclosure requirements
• Advertising and consumer protection laws
• Social media platform terms of service
   

Clear and conspicuous disclosure of affiliate relationships is required on all promotional content.

Affiliates may NOT:

• Engage in deceptive, fraudulent, or misleading advertising
• Make health, medical, or therapeutic claims
• Use spam, unsolicited messaging, or automated outreach
• Bid on SinseFresh trademarks, brand names, or variations in paid advertising without written permission
• Misrepresent affiliation with SinseFresh or impersonate the brand
• Promote SinseFresh on websites or platforms containing illegal, explicit, or offensive content
   

Violation of these rules may result in immediate termination and forfeiture of commissions.

Commission rates, payment schedules, and payout thresholds will be communicated separately upon approval into the Program and may be updated at SinseFresh’s discretion.

Commissions are earned only on qualified, completed sales that:

• Originate from approved affiliate links or codes
• Are not refunded, canceled, or disputed
• Comply with all Program terms
   

SinseFresh reserves the right to withhold or reverse commissions for fraudulent, suspicious, or non-compliant activity.

SinseFresh grants Affiliates a limited, non-exclusive, non-transferable license to use approved brand assets solely for participation in the Program. All intellectual property remains the exclusive property of SinseFresh.

Affiliates may not alter logos, trademarks, or brand assets without written approval.

Either party may terminate participation in the Program at any time, with or without cause. Upon termination, all promotional use of SinseFresh branding must cease immediately.

SinseFresh reserves the right to terminate any affiliate for violation of these Terms, brand misuse, or conduct deemed harmful to the brand.

SinseFresh shall not be liable for indirect, incidental, or consequential damages arising from participation in the Program. Total liability shall not exceed the total commissions paid to the Affiliate in the preceding three (3) months.

Affiliates agree to indemnify and hold harmless SinseFresh from any claims, damages, losses, or expenses arising from their promotional activities, content, or violation of these Terms.

SinseFresh reserves the right to modify these Terms & Conditions at any time. Continued participation in the Program after changes constitutes acceptance of the updated terms.

This Agreement shall be governed by and construed in accordance with the laws of the United States and the state in which SinseFresh is headquartered, without regard to conflict of law principles.

SinseFresh products and related content may be associated with industries that are subject to heightened regulatory oversight, advertising restrictions, platform policies, and evolving laws (collectively, “High-Risk Industries”). These may include, but are not limited to, botanical products, herbal infusions, dietary-related tools, and other regulated consumer categories.

Affiliates acknowledge and agree that:

• Approval into the SinseFresh Affiliate Program does not guarantee compliance with all advertising platforms, payment processors, or third-party services.
   
• Affiliates are solely responsible for ensuring that their promotional activities comply with all applicable laws, regulations, platform rules, and regional restrictions.
   
• SinseFresh does not provide legal, medical, regulatory, or compliance advice to affiliates.
   
• Affiliates must not make health, medical, therapeutic, or outcome-based claims unless explicitly authorized in writing by SinseFresh.
   
• Certain platforms may restrict, limit, shadow-ban, or remove affiliate content without notice, and SinseFresh shall not be held responsible for such actions.
   

Affiliates assume all risks related to content publication, advertising approvals, account suspensions, or payment disruptions arising from participation in High-Risk Industries.

SinseFresh reserves the right to restrict, pause, or terminate affiliate participation based on regulatory changes, platform policy updates, or risk assessments at any time. 

By submitting an Affiliate Application or participating in the SinseFresh Affiliate Program, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
